Judge rules former Miami commissioner will remain on ballot

MIAMI — The top two vote-getters in a Miami City Commission election will indeed head to a runoff.

Voters will choose between Frank Carollo and Rolando Escalona to fill the city’s District 3 seat.

During the election earlier this month, voters did not give any candidate more than 50% of the vote, but they did cast more ballots for Carollo and Escalona than anyone else.

Voters also made their voices heard on the issue of lifetime term limits, which since approved, would have potentially disqualified Carollo from the runoff after he previously served two terms on the commission a decade ago.

Lawsuits were filed trying to remove Carollo from the ballot and replace him with third-place finisher Oscar Alejandro.

On Wednesday, a judge denied the request for a temporary injunction, meaning no changes would be made, deferring the election contest claim due to the fact that the election has not concluded yet.

The runoff election is set for Dec. 9.
