Hollywood man faces DUI manslaughter charge for red light crash that killed 77-year-old passenger

HOLLYWOOD, Fla. — Police arrested a Hollywood man on a DUI manslaughter charge Thursday in connection with a May 5 crash that would lead to the death of his passenger nearly a month later.

Investigators said Nicky Antonio Marte, 45, was driving his Volkswagen Routan minivan with his 77-year-old neighbor, Hosea Harvey, in the passenger’s seat when he ran a red light as he drove south on North 56th Avenue and Sheridan Street and was T-boned by a woman in a Chevrolet Cruze.

A report from the Hollywood Police Department states that Harvey lived five doors down from Marte at The Club at Emerald Waters condominium complex off North 56th Avenue and Stirling Road, about a mile north of the crash scene.

Investigators said after officers arrived, Marte drove off, saying he was going to the hospital because “rescue was taking too long” to get Harvey to the hospital.

Medics then arrived and took Harvey to Memorial Regional Hospital, where he would die from his injuries on June 3.

Police said they saw signs of impairment from Marte, who claimed to have only had one drink. They said he abruptly stopped performing field sobriety exercises, which he was failing, and asked an officer, “What do you want me to do, boss?”

State driving records show Marte was previously convicted of DUI in Palm Beach County back in 2004. He completed DUI school.

As of Friday, Marte was being held in the Broward Main Jail on a $100,000 bond.
